Terms of Service

1. Who we are

Allergent ("Allergent", "we", "us") is operated by [legal entity name], registered in the Netherlands (KvK [number]), [registered address]. These Terms govern your use of our website and progressive web app (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy.

2. What the Service is — a guide, not a guarantee

Allergent helps you see how dishes on a restaurant's menu relate to your chosen allergens — shown as safe, adaptable, may contain or contains. The Service is an information tool. It does not prepare, handle or serve food, and it cannot guarantee that any dish is safe for you.

  • Allergen and menu information is supplied by the restaurants and may be incomplete, out of date, or wrong despite our and their efforts.
  • Cross-contamination, recipe changes, substitutions and individual sensitivity mean a dish marked "safe" or "adaptable" may still not be safe for you.
  • If you have a serious or life-threatening allergy, always tell restaurant staff and confirm directly with the kitchen before you order. Never rely on the Service alone.

3. Restaurants are responsible for their menu data

Restaurants publish and maintain their own menus and allergen information through Allergy Menu and are solely responsible for the accuracy, completeness and currency of that information and for the final allergen check of every dish they serve. A restaurant warrants, when it publishes, that its information is accurate to the best of its knowledge. Allergent does not independently verify each dish and is not a party to the relationship between you and a restaurant.

4. Eligibility & accounts

You can browse menus as a guest. Some features need an account. You are responsible for your account credentials and for activity under your account.

Age. The age of digital consent is 16 in the Netherlands; for users in other EU/EEA Member States the locally applicable age under Art. 8(1) GDPR governs. You must meet that age (or have verifiable parental consent) before creating an account or providing allergy information. [Implement an age gate before any account or health-data collection.]

5. Your allergy information

Allergy and dietary information is special-category health data under Art. 9 GDPR. We process it only on the basis of your explicit consent (Art. 9(2)(a)), and you can withdraw that consent at any time in your Account, which stops the processing and deletes the stored profile. As a guest, your allergens stay on your device and are used only to filter menus locally. See the Privacy Policy for full detail.

6. Acceptable use

  • Don't misuse the Service, attempt to break or overload it, or scrape it at scale.
  • Don't submit false menu or allergen data, or impersonate a restaurant you don't represent.
  • Don't use the Service for any unlawful purpose or to infringe others' rights.

7. Community content & points

If you contribute content (for example by scanning a menu) you grant us a licence to use it to provide and improve the Service. Points and rewards have no cash value, may change, and may be removed for misuse.

8. Intellectual property

The Service, its design and software are owned by Allergent or its licensors. Restaurant names and marks belong to their owners.

9. Changes to the Service and these Terms

We may update the Service and these Terms. If we make material changes we will give reasonable notice. Continued use after changes take effect means you accept the updated Terms.

10. Disclaimers & liability

10.1 What we never exclude. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Dutch or EU law, including liability for death or personal injury caused by negligence, for intent or gross negligence, for fraud, or any mandatory statutory consumer rights — including conformity rights under the EU Digital Content Directive (2019/770) as implemented in Boek 7 BW, which apply even though the Service is provided without monetary payment.

10.2 The guide is not a guarantee. Subject to clause 10.1, the Service and its allergen classifications are provided for information only and without warranty that any dish is safe for you; the responsibility for what you eat, and for confirming it with the restaurant, remains yours.

10.3 Limitation. Subject to clause 10.1, and to the extent permitted by law, our total liability arising from the Service is limited to [a defensible amount to be set with counsel]. We are not liable for losses caused by inaccurate restaurant data, for which the restaurant is responsible. [Counsel to confirm the cap and warranty wording are valid against consumers under Arts. 6:236–6:237 BW.]

11. Governing law

These Terms are governed by the law of the Netherlands, and disputes are subject to the competent court of [district]. If you are a consumer resident in the EU/EEA, you keep the protection of the mandatory rules of your country of residence and may use the EU Online Dispute Resolution platform.
